The criminal age of responsibility in Scotland is currently 8 years of age. There is a very robust system in place whereby the authorities seek to keep wayward children out of the main Criminal Justice System until, but not necessarily confined to, the age of 16.
It can be a harrowing experience for any parent to find that their child has “criminal” allegations against him or her. Whilst the Children’s Panel System is geared at all times to have the best interests of the child at the forefront, it can be very daunting not only for the child but for the parents too. It is essential at this stage that everyone, Mum, Dad and the child are properly advised and represented and, if they feel that the allegations are unfounded, that the Panel is asked to refer the matter to the Sheriff Court where a hearing can be fixed and evidence led.
